Serving size cap 15mg per serving, with a maximum of 2 servings per container for beverages. The concentration limits for hemp-derived cannabinoid in beverages sold in keg containers of 650 mg of hemp-derived cannabinoid per 15.5 gallon keg container, and 325 mg of hemp-derived cannabinoid per 7.75 gallon keg container.
Out of state brand owners (that contract manufacture) are required to obtain supplier licenses but subject to fewer disclosure requirements than in-state manufacturers. A license is also required for engaging in the wholesale distribution of hemp beverages and defines "wholesaler" to mean a person that purchases finished and packaged for consumption hemp beverages, not considered intermediate products still in the pre-packaging stage, from licensed suppliers, or from other licensed wholesalers, and that sells hemp beverages for resale and not for consumption.
Must also register brands with the TN DoR before selling.

As of Jan. 1, 2026: Brands must be registered with the Department of Revenue ($300 annually per brand). Brands distinguishable by category, type, and delivery system must be separately registered with the DoR and may require a supplier to include with its submission of the registration form any supporting documents as deemed necessary by the department for registration.

See Tenn Code Ann. 43-27-209. Labeling required: (A) A list of ingredients and possible allergens and a nutritional fact panel; (C) If the product is ingestible, the amount of cannabinoid in each serving of the product, measured in milligrams; (D) The total amount of hemp-derived cannabinoid in the entire package, measured in milligrams; (E) The net weight of the product; (F) A quick response (QR) code that can be scanned to access a website providing the product's batch number, date received, date of completion, method of analysis for the testing report required under § 43-27-207 , including information regarding results of the product's full-panel and potency tests conducted pursuant to § 43-27-207(a) ; and (G) An expiration date.
No related imagery or scenery that depicts or signifies characters or symbols known to appeal primarily to persons under twenty-one (21) years of age, including, but not limited to, superheroes, comic book characters, video game characters, television show characters, movie characters, and unicorns or other mythical creatures.
Manufacturers must, in addition to labeling requirements under the Act, label each beverage with the following: (a) Batch number; (b) Name and address of the product manufacturer or distributor; (c) A list of all ingredients, ordered by weight, including direct and indirect additives; (d) A separate allergen statement, stating common name of allergen, if product contains any of the following ingredients: eggs; fish; milk; tree nuts; peanuts; sesame; shellfish; soy; or wheat; (e) A QR code that when scanned links the viewer to COA testing results conducted under this chapter. A QR code that does not link to the landing page designated by the testing laboratory as registered with the department shall be considered invalid and a violation of this rule; (f) Serving size of the product and the total number of servings per package of the product (applicable only for Ingestible hemp products); and, (g) The numerical count, net weight, or net volume of the product per package. Net weight and net volume must be reported in both standard and metric measurements.
Warning statements: Printed in 6-point, easily legible font on the label panel. "Warning: Keep out of reach of children. Must be 21 or older to possess or consume. May be harmful to those who are pregnant or breastfeeding. May impair ability to drive or operate machinery. This product is not approved by FDA for cure, mitigation, treatment, or prevention of any disease." The word "Warning" must be printed in bold font, all capital letters.
Packaging must be designed or constructed to be significantly difficult for children under 5 years of age to open or obtain a toxic or harmful amount of the substance contained therein within a reasonable time and not difficult for normal adults to use properly, but does not mean packaging which all such children cannot open or obtain a toxic or harmful amount within a reasonable time. Child-resistant effectiveness of not less than 85 percent without a demonstration and not less than 80 percent after a demonstration of the proper means of opening such special packaging. In the case of unit packaging, child-resistant effectiveness of not less than 80 percent.
