Labeling Description

All food processing establishments shall utilize and apply the generally recognized federal standards for food labeling in 21 C.F.R. Part 101 (2023). All food products shall conform to the following requirements regarding the use of color additives: (A) 21 C.F.R. Part 73 (2024); (B) 21 C.F.R. Part 74 (2024); (C) 21 C.F.R. Part 81 (2024); (D) 21 C.F.R. Part 82 (2024). In addition, beverages must include the following on labels:

1.Statement of Identity – the name of the product.

2.Net Quantity of Contents – the amount of product tin the package. If the product is solid, semisolid or viscous, it is expressed in terms of weight and if the product is liquid, it is expressed in terms of volume. If numerical count is used, (e.g., 12 gummies), a net weight is still required to be listed on the product.

3.Ingredient List – ingredients in the product, listed in descending order of predominance by weight.

4.Statement of Responsibility – name and address of the business.

6.Cannabinoid Content – all cannabinoids listed on the hemp cosmetic label must have the total milligrams per container identified; all cannabinoids listed on the hemp dietary supplement or hemp food label must have the milligrams per serving identified; all other hemp products must identify the cannabinoid profile of delta-9-tetrahydrocannabinolic acid (THCA), delta-9-THC,

cannabidiolic acid (CBDA), cannabidiol (CBD) and any other cannabinoid listed on the product label.

7.Batch/Lot Coding – a code permanent and visible to the naked eye that specifies the establishment where the product was packed; the product contained therein; and the year, day and period during which it was packed.

8.Nutritional Information – unless exempt, hemp food products must provide nutritional information in the form of a Nutrition Fact label and hemp dietary supplement products must provide nutrition information in the form of a Supplement Fact label.

9.An ingredient that is or contains protein from a “major food allergen” must have the presence of the allergen declared by common name in the ingredient statement or by placing the word “Contains” followed by the name of each major food allergen preset in the food or dietary supplement. The “Contains” statement must be immediately after or adjacent to the ingredient statement. The “major food allergens” are milk, eggs, fish, crustacean shellfish, treen nuts, peanuts, wheat, sesame, and soybeans. They type of tree nut (e.g., almonds, walnuts, pecans, etc.), fish (e.g., anchovies), and crustacean shellfish (e.g., crab, lobster, shrimp, etc.) must be declared.
