5mg per serving (where a serving is no less than 12 ounces). Each serving must be in an individual, tamper-evident container and distinct from other servings contained in the same package. A package of beverages is limited to four individual containers. Cannot use any distillate or concentrate containing any derivative of a THC component that is not a naturally occurring cannabinoid to produce a consumable hemp product.

Out-of-state producers can obtain a permit via a general application process, and permitted processors can then submit products for registration: https://ldh.la.gov/bureau-of-sanitarian-services/hemp-registration. Out-of-state producers that cannot obtain a permit may still use in-state permittees to sign off on products for registration.

The state issued new rules and regulations related to out-of-state processor licensing which took effect on January 20, 2026. Processing or manufacturing facilities located in another state can obtain LA permits if all of the following conditions are met: 

1. The applicant holds a valid permit for the facility issued by the state's health department, or equivalent agency; 

2. The permit fee is paid;

3. The applicant discloses the legal name and ownership interest of each person owning more than a 5 percent interest in the applicant;

4. The applicant and facility comply with all applicable requirements of Part VI of Chapter 10-a of R.S. Title 3, this Section, and this Chapter

Additionally, each separate and distinct consumable hemp product must be registered with the department annually and 90 days of the effective date of these regulations (Jan. 20, 2026) or prior to marketing the products in the state of LA.

For registration, the state will conduct an initial review of any product submitted pursuant to this Section and notify the submitting party of any deficiencies existing which prevent the approval of the product within sixty business days of the date of submission. If the department fails to notify the submitting party within sixty business days of the date of submission, the product may be sold by a wholesaler or retailer permitted pursuant to R.S. 3:1484 from the day following the sixtieth business day until the submitting party receives final approval or denial from the department for the product.

Product cannot be marketed as dietary. RS 3:1483(B)(4).

Label must:

Contain no medical claims. See above and La. Admin. Code 49:523.

Have a scannable bar code, QR code, or web address linked to a document or website that contains a certificate of analysis as provided in Subsection E of this Section.

Clearly state the amount of total THC per serving.

Accurately reflect the contents of the packaging with a variance of no greater than fifteen percent.

Marijuana rules apply.

Labeling on THC-containing products must bear a disclaimer that consumption of such products may cause the user to fail a pre-employment or routine drug screen.
